before you place any order with Specsfinder, as all accepted
orders are
bound by these Terms and Conditions. This document sets out
the Terms & Conditions of our supply to you, the purchaser
of products ordered through specsfinder.co.uk website. If you
do
not understand these terms and conditions please contact us
via email, and do not place your order via our website until
you
have read and understood these terms and conditions fully.
General
1. These Terms and Conditions do not remove or affect your statutory
rights at law.
2. No binding contract exists between you the customer and Specsfinder
Ltd. until your order has been accepted and confirmed.
3. For any order, (contract) placed via the Specsfinder.co.uk
website, you will have a 24 hours period from the date when
the order is placed, in which to cancel this contract. This right
does not apply after we have started to customise materials,
including manufacturing any goods in accordance with your requirements.
4. All products and goods are sold subject to availability and
for delivery within 28 days of the order being received.
5. These terms and conditions are our trading terms and conditions
and cannot be altered or varied by any representatives, staff,
agents or sales persons, unless you, the customer, receive
that variation in writing from Specsfinder Ltd.
6. Any contract entered into via the Specsfinder Ltd is considered
personal and applicable to the requesting customer and as such
it is not to be considered as transferable.
7. You confirm that you are not registered partially sighted
or blind.
8. Specsfinder Ltd reserves the right to review and amend these
terms and conditions as and when circumstances dictate.
9. Specsfinder Ltd partners and suppliers, will always endeavour
to provide the heights quality of service, and are solely governed
by there own countries laws and terms and conditions.
Description of Goods and Services
1. A description of the goods is set out on our website and
any other documents referred to on our website. Whilst we
will attempt to ensure that there are no changes to the goods
to be supplied, it is possible that there might be some minor
variations to the description and/or specification of the
goods which arise by virtue of changes made by the manufacturers
of the parts supplied which form part of the goods.
2. When ordering, you must provide us with details of the relevant
prescription that is to be applied to the goods. All prescriptions
provided to us must have been given to you by an appropriate
registered medical practitioner or registered ophthalmic optician
following a sight test within the last 24 months.
3. We will rely upon the prescription provided by you and the
goods provided will contain lenses matching the prescription
that you submitted.
4. Specsfinder Ltd shall not charge you for goods that we
cannot supply for any reason. However, we will not be responsible
for any damage or losses that you may suffer if we fail to
supply goods.
5. Specsfinder Ltd have attempted to display all the goods
on the specsfinder.co.uk website as accurately and fairly as
possible, taking account of the available reproduction techniques
that apply to website design, graphical and photographic technology.
6.
If you are unsure of the relevant prescription to be applied
to the goods, please consult a registered medical practitioner
or registered ophthalmic optician before placing an order.
7. We strongly recommend you order your spectacles using your
pupillary distance, PD, as measured by your Optician. If there
is no PD measurement on your prescription, then consult your
optician to obtain your PD before ordering. If you do not provide
the PD, and unless you state otherwise, we use an appropriate
average 'PD' to complete your order.
8. You must be over the age of 18 to order from Specsfinder.co.uk,
and you must not be ordering on behalf of someone under 18
years of age.
9. We will not fulfil orders for lenses of 8 dioptres and over.
You must not attempt to place an order of this kind. For varifocal
lenses we will not fulfil orders for lenses of over +/- 6 spherical
and +/- 2 cylindrical values.
10. We will not fulfil orders for lenses where the sphere value
added to the cylindrical value equals 8 dioptres and over.
You must not attempt to place an order of this kind. For varifocal
lenses we will not fulfil orders for lenses where the spherical
value added to the cylindrical is 6 dioptres and over.
Delivery
1. Unless agreed otherwise in writing, delivery of the goods
will take place at the delivery address stated on the order
form.
2. Unless agreed otherwise in writing, delivery of the goods
must be to a UK address.
3. Unless agreed otherwise in writing, delivery of the goods
will take place within 28 working days.
4. Any dates specified by us for delivery of goods are intended
to be an estimate and time for delivery is not guaranteed.
If no dates are specified, we will endeavour to deliver within
a reasonable time.
5. If for any reason (not due to our fault), you do not accept
delivery of any of the goods in accordance with this paragraph,
then we may charge you an additional fee to cover any additional
direct costs incurred by us as a result (including additional
insurance, delivery, storage or similar charges).
6. Postage and packaging is free in the UK, however this may
be subject to change without notice. We use Royal Mail, and
send your orders using 1st class post. Any other service you
request may be chargeable.
7. Subject to the other provisions of these Terms, Specsfinder
Ltd shall not be liable for any loss, whether direct or consequential,
economic or loss of profits or otherwise, arising directly
or indirectly out of any delay in the delivery of the Goods
nor will any delay entitle the Buyer to terminate or rescind
the Contract unless the delay exceeds 90 days.
Inspection of Goods
1. Risk in the Goods shall pass to the Buyer on delivery
2. Upon delivery of the goods you should carefully inspect
them. If any of the goods are damaged or lost, please contact
us to inform us of the problem and do not use the goods.
3. The goods will contain written confirmation of the prescription
as a reference. If the prescription stated does not match the
prescription ordered, please contact us to inform us of the
problem and do not use the goods.
Price
1. Prices displayed on our site, in our leaflet, price lists
or other sales literature are correct at the time of display.
We reserve the right to alter prices from time to time without
notice. However, once we have accepted your completed order,
we will not change the price that applies to such order.
2. We make every effort to maintain prices but prices may occasionally
move up or down depending upon changes in raw material or other
processing costs.
3. The price for the goods includes any value added tax payable.
Payment
1. Unless we agree otherwise in writing, you must pay us the
price for the goods when placing your order.
2. Payments to us must be made in pounds sterling only.
3. Transmission of your debit or credit card number or other
data in relation to payment for the goods shall be at your
entire risk. We cannot accept any responsibility or liability
for failures in transmission of information, deletion, non-delivery
or failure to store any communications by you.
4. If you have any concerns or questions about the safety and
confidentiality of your credit card details, please contact
us for more details.
Your Rights to Cancel this Contract
1. If this contract has been made between us by telephone or
correspondence (including e-mail) without any face to face
contact having occurred between us, then you will have a 7
day period from the date when the order is placed in which
to cancel this contract.
Responsibility for and Ownership of Goods
1. You will be liable for any loss or damage to the goods from
the time of delivery unless such loss or damage is caused by
our negligence.
Resale of goods
1. Goods are sold on the condition that they are not resold
to the public.
Returns
We are sure that you will be very happy with your purchase.
However, we will act promptly if the goods we send you are
damaged, defective or incorrect.

Return/Refund Policy
Please follow appropriate steps depending
on reason for returning goods:-
1. If you take delivery of a package and the contents have
been damaged in transit, you can return the item(s) to us
within 7 days of receipt for exchange. Please contact us
by e-mail,

as soon as possible to inform us of your wish to return your
goods.
2. Specsfinder Ltd will not take responsibility or provide
a refund for goods not thought of as being aesthetically
pleasing to the eye or breakages due to non recommended lenses.
3. Specsfinder Ltd is unable to provide any warrantees
in cases were the frames or lenses broke, however you can
always
contact our sales department to solve such problems with
a refund or replacement (subject to availability of frames/Lenses
and our discretion on this matter).
4.In regards to the 100% money back guarantee, if you are
not satisfied with the quality of the lenses or frame, Specsfinder
Ltd will provide you the customer with a 100% refund on the
frame cost and 50% of the prescription lenses cost. Note,
unlike other glasses retailers we will not be charging you
with
any admin
cost,
but we reserve the right to alter this without notice.
5. If the item is defective you have the right to return
a faulty item within a reasonable period of time. Please
contact
us by e-mail,

as soon as possible to inform us of your wish to return your
goods.
You must also include your
original order number, with your name, email, credit card
bank name and address. Note, any products returned to Specsfinder
Ltd by you the customer,
we will not be able to refund you for the cost of the postage
and packaging.
6. If we sent you an item you did not order, an incorrect
item, please contact us by e-mail,
(info@specsfinder.co.uk)
as soon as possible, to inform us of the details of the error,
and your wish to return
your goods. You must also include your original order number,
with your name, email, credit card bank name and address.
Note, any products returned
to Specsfinder Ltd by you the customer, we will not be able
to refund you for the cost of the postage and packaging.
7. In the event that Specsfinder Ltd send you a replacement
for a damaged, defective or incorrect item, you must return
the original item to us within 28 days of our e-mail confirming
the issue of the replacement item. Provided you return this
item to us within the 28 days, you will have nothing more
to pay. If you do not return the original item to us by the
end
of the 28 day period, we reserve the right to charge an amount
equal to the price of your original order to the payment
card you used for the order.
Limitation of our Liability to you
Please read carefully the information stated below before you
place your order as you will be bound by these Terms if we
accept your order. If you have any queries regarding these
Terms (or the order form) please raise them with us as soon
as possible and in any event before you place your order.

or restrict any rights which applicable law grants to you in
respect of such goods. Individual goods may be the subject
of additional warranties or guarantees given by their manufacturers
directly to you.
2. We do not accept any responsibility and will not be liable
for any damage to the goods caused by you.
3. We shall not be liable to any person for any damage or loss
that may arise from the use of any goods advertised on our
site, leaflets or any of our literature.
4. Without prejudice to your statutory rights, all the information
and materials contained in this site (including, without limitation,
text, graphics and links) are provided on an "as is" basis
with no warranty and in particular, we do not represent or
warrant that the information accessible via this site is accurate,
complete or current or that the use of this site will be uninterrupted
or error-free.
5. Nothing in these Terms excludes or limits our liability
for death or personal injury resulting from our negligence
or any breach of the statutory implied terms as to title of
goods or for fraud or any other liability which by law we are
not permitted to limit or exclude.
6. Our maximum liability (and that of our employees, agents
and subcontractors) to you in connection with any physical
damage caused to your property through the negligence of us
(or our employees, agents and subcontractors) will not in any
circumstances exceed £100.
7. In all other cases, our total liability (including our employees,
agents and subcontractors) whether in contract, tort (including
negligence) and breach of statutory duty or otherwise will
not exceed the price of the goods and services to which the
claim relates.
8. In no circumstances will we (or our employees, agents or
subcontractors) be liable to you for any business interruption,
loss of use, loss of data, loss of profits, contracts, goodwill
or anticipated savings.
Data Protection
1. We will ensure that our employees, agents, partners and
sub-contractors shall, at all times, comply with the provisions
of the Data Protection Act 1998 in relation to data received
from you in relation to this contract and shall only process
personal data received from you where necessary to fulfil our
obligations under this contract.
Security
1. At Specsfinder Ltd we are 100% committed to protecting
your security and privacy. The information you send us is protected
by using Secure Socket Layer (SSL) technology (shown by the
padlock in the bottom right hand corner of the screen). This
shows that your information cannot be intercepted as it travels
over the net. Once your information reaches us it is stored
behind firewall's to prevent unauthorised access.
2. Currently all user information is securely stored and all
orders are processed on our servers, which are outside of Europe.
3. We reveal only the last five digits of your credit card
numbers when confirming an order. Of course, we transmit the
entire credit card number to the appropriate credit card company
during order processing.
4. We maintain physical, electronic and procedural safeguards
in connection with the collection, storage and disclosure of
personally identifiable customer information. Our security
procedures mean that we may occasionally request proof of identity
before we disclose personal information to you.
5. It is important for you to protect against unauthorised
access to your password and to your computer. Be sure to sign
off when you finish using a shared computer.

1. All communications between Specsfinder Ltd and its customers
will only be recognised if it is in writing and must be sent
by first class post, facsimile or email. (With confirmation
received). Any written communication will be treated as having
been served on the person receiving it 3 working days after
posting (if sent by first class post) or at the time of transmission
(if sent by facsimile and a satisfactory transmission report
is obtained) or at the time and date stamp if received by
email and confirmation of receipt is received by the sending
party.
